WTA Supports Targeted Reconsideration of FCC’s Privacy Rules
WTA filed reply comments in response to nearly a dozen petitions for reconsideration and several oppositions regarding the FCC’s Broadband Privacy Order adopted in October 2016. WTA urged targeted reconsideration of the Order to address concerns that (1) the FCC exceeded its authority under Section 222 regarding the scope of customer information covered by the rules by expanding their scope beyond CPNI, (2) first-party marketing should not be prohibited unless targeted using CPNI, and (3) the breach notification trigger and timeline must be re-calibrated such that small carriers can implement them. WTA looks forward to working with the FCC and other stakeholders to ensure that consumers are protected while avoiding unnecessary and overly burdensome regulation for carriers that divert critical broadband deployment resources.
